For the purposes of this site and for clarification; wherever the term Member or Membership appears in writing, it refers purely to the user and user functionality level of this site. None of the users have any affiliation to The Model Mall and they do not in anyway represent the views of the owners, staff or associates of The Model Mall.

All payments to the site are for upgrades in functionality whilst on the site and for the ability to display more images, therefore, having a larger presence on the site in which to promote themselves further. The payments help towards the running costs of the site for the benefits of all it's users.
You agree, through your use of this site, that you will not post any material which is false, defamatory, inaccurate, abusive, vulgar, hateful, harassing, obscene, profane, sexually oriented, threatening, invasive of a person's privacy, adult material, or otherwise in violation of any UK, International or United States Federal law. You also agree not to post any copyrighted material unless you own the copyright or you have written consent from the owner of the copyrighted material.

Spam, flooding, advertisements, chain letters, pyramid schemes, and solicitations are also forbidden on this site.

With this user account you are about to register, you agree to never give your password out to another person except an administrator, for your protection and for validity reasons. You also agree to NEVER use another person's account for any reason. We also HIGHLY recommend you use a complex and unique password for your account, to prevent account theft.

After you register and login to this site, you will be able to fill out a detailed profile. It is your responsibility to present clean and accurate information. Any information the site owner or staff determines to be inaccurate or vulgar in nature will be removed, with or without prior notice. Appropriate sanctions may be applicable.

Please note that with each forum post, your IP address is recorded, in the event that you need to be banned from this site or your ISP contacted. This will only happen in the event of a major violation of this agreement.

Also note that the software places a cookie, a text file containing bits of information (such as your username and password), in your browser's cache. This is ONLY used to keep you logged in/out. The software does not collect or send any other form of information to your computer.

You agree not to post ADULT images on this site and will not allow any images of a graphic sexual content to be uploaded to our servers. This includes sexual depictions of animals, children, and hard-core images. If any such material is found, we reserve the right to delete the images without any notice. If any site users discover such material, please use the contact us page and inform us immediately.

Any images uploaded should be from the copyright holder or you should have permission from the copyright holder to display the images on this website. Breaking of UK copyright law is a very serious offence and your membership will be looked at if you are found to be posting images that don't belong to you.

If a user breaks the terms and conditions set out in these policies or are deemed to be causing other user's distress we reserve the right to a complete ban from the site, without refund.

Upgrading your 'membership' to a higher level only gives you the extra facilities, image upload capacity and privileges, you are not paying for a more secure service and we cannot be held responsible for downtime or loss of service due to technical difficulties.

We aim to upgrade your account within 24hrs when paid by paypal, this will be done when we have received confirmation of your upgrade.
We cannot be held responsible for delays in the processing of payments. You are to ensure you add your user name to your order; failure to do so will delay the process.

It is your responsibility to notify us of any problems with your upgrade (i.e if you believe your account has not been upgraded within 24hrs) via email.
If it has been deemed appropriate to ban a user from the site for any reason, no refund will be given.

This site is solely for the users who are over the age of 18. If it has been brought to the attention of this site's owners, staff or moderators that a user is under the required age limit, the site owners reserve the right to suspend membership until proof of age has been provided by the alleged underage user.

If no proof is presented within a reasonable timeframe, 'membership' will be cancelled without refund.

It the responsibility of the user to provide content and images for their portfolio/profile, and it is also the responsibility of the user to generate their own work or collaborations by use of the forum, the PM system and their Portfolio/Profile information. TMM cannot guarantee work or assignments for any user.

The Model Mall reserves the right to decline uploading of a portfolio if The Model Mall's name will be harmed or brought into disrepute due to content. However, the customer will be given the opportunity to provide acceptable material. Failure to do so constitutes a breach of contract and therefore no refund will be given.

Users uploading images to The Model Mall site should ensure they have a copy of the image or images. The Model Mall cannot be held responsible for the loss of any image or images uploaded.

No refund or compensation will be paid in the event of loss of service or images or for any period of downtime caused by our hosting service.

We reserve the right to cancel any 'membership' without warning and without refund if any of the above terms and conditions are broken.

You agree to not post URL's and other web links in any form, into your personal Portfolio or forum profile section as links or text, that lead to ADULT SITES or Pay Sites or any links that lead to other portfolios or forums on other websites. The Model Mall reserves the right to remove from its site any links defined above without notice.

You agree not to link or hot link any images from this site for use on other sites that use our bandwidth.

You hereby agree to indemnify, and shall keep indemnified, The Model Mall its staff, its subsidiaries, or this Site's owner from and against any and all actions, proceedings, costs, claims, damages and demands (including reasonable legal expenses) in respect of any breach or non-performance by you of any or all of the undertakings, warranties, and obligations in these Terms and Conditions.

Revision of Terms and Conditions: The Model Mall may amend or modify these terms and conditions at any time without notice. Users are responsible for reviewing this page from time to time to ensure compliance. Any use of the site by you after such update shall be deemed to constitute acceptance by you of such amendments and modifications.

Jurisdiction: This agreement shall be governed, construed and enforced in accordance with English law. If any provision of this agreement shall be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from this Agreement and shall not affect the validity and enforceability of any remaining provisions.

* Price increases may occur, however, The Model Mall will ensure that the customer is informed of these changes prior to implementation of the new tariff.

NB. For the purposes of these Terms and Conditions, the term 'you' or 'yours' is defined as the customer or user and the terms 'us' or 'ours' is defined as The Model Mall, it's owner, staff, subsidiaries or anyone involved in the running of the site.
